Montana Democrat Jon Tester voted against the DREAM Act last Saturday. While he was not alone, he did manage to upset one person who actually mattered a lot to Tester's being elected - Markos Moulitsas at the Daily Kos, one of the web's most popular blogs. Since your child turned 21 even before you submitted your I-140, the answer is NO, you cannot submit I-485 for him as he is not covered by Child Status Protection Act, CSPA.

Hello,
I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

Hi. I am a Canadian Citizen that was offered a Management job in US.
I would appreciate any advice in regards the best way to ensure a LONG stay in US. The company wants to start with a TN.
Strategy #1:
To stay under TN and keep it renew it for a long term �. 10-20 years. The risk is that the guys at the border will say no at some point; however I wonder if I can request an appeal since there is no limit per TN rules.
( are there any cases that have stayed that long?)
Strategy #2:
Start with a TN then file an H1b and wait for the Labor of certification to be approved. If I do not hear anything in 1 or 2 years; change to TN to revise the strategy�. in order to avoid consuming the H1b 6 years lead time allowed and try again later.

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. I Just learnt that the Name Check for my I-485 was processed under a different Alien number when it should be processed by alien number assigned in I-485 case. Since it was cleared under a different number (probably the one for I-140), I-485 file did not have this information and now they are getting it fixed. So when everything in my case is current, this came up right at the time when they will almost be getting out of visa #s. :(
I recommend you should all contact your service centers where your I-485 was filed and make sure that yoru name check is in process or got processed under correct alien number. If the service center refuse to provide any information, contact your congressman office and have them verify this information. You can find who is your local congressman by going to http://www.visi.com/juan/congress/.

Hi,
We are going to India on Vacation in Aug 2008. I am on H1B visa and my daughter (3 yrs) is on H4 (My dependent). My wife came to US as my dependent on H4 visa. But now she is on L1B visa.
Q1: Can I add my wife as a co-applicant while booking the appointment online even though she is not my dependant )so that we can all appear for the interview at the same day and time)? I didn't find any guidelines related to this anywhere.
Q2: We are looking for an appointment on Sep first week. Will the slots for Sept available by Aug 1st week? How many days before I can book the appointment?

After at least 3 - 4 calls, over the last month, I finally spoke to IO at NSC. And she took my LIN numbers(other IOs did not even bothered). And then after 1 minute she replied that..my case is waiting to be assigned to Officer.
I even got my I140 checked but she was patient and told my HR that whole cas e is waitng to be assigned to Officer.
Is this something to be looking forward to or is it a usual reply?
Did anyone get this kind of reply?

Anyone following the cap count would see that H1B numbers have gone down from 45500 to 44400 in one week. Since obviously even if no one submitted an H1B applicn last week, the only way numbers could have gone down is if USCIS denied 1100 applications. Seems like a high number of rejections in one week. My guess is these numbers reflect the the RFE(impossible to reply RFEs) cases that were sent to the premium processing and a few regular processing cases that ran out their time limit and got denied. It will be funny( for the anti immigrants) to see if the Cap count numbers continue to go down and guess by sept 2010, the numbers still available in the quota would be around 60k?!?
Just another example of the ruthless and cold hearted stand that USCIS is taking towards highly* skilled immigrants.

Hello,
I have attended Toronto consulate on Apr 18th for my 7th yr h1b stamping. I have i140 approval. The consul gave me 221g yellow form and later received 2 emails asking for some documents which I submitted. I still have not heard any response and I understand it could take months before I get any answer. My question is can I leave Canada and go to India while the process is in review and come back to Canada if and when my H1b stamping is approved. I have multiple entry visa to Canada so I could potentially come back. My question is can I leave Canada while my visa is under process and would it have any affect?
